What Records the Pulaski County Circuit Clerk Holds

When a North Little Rock resident files for dissolution of marriage, the Pulaski County Circuit Clerk keeps the full case file. That includes the petition, service documents, any motions or responses, court orders, property agreements, parenting plans if children are involved, and the final decree. All of this is in the Pulaski County system, not in any North Little Rock city office.

Most dissolution records in Arkansas are public by default under Ark. Code Ann. § 25-19-105 and Admin Order No. 19. However, some documents that involve minor children may be restricted or redacted in the public version. What you can access as a member of the public is typically the case index, docket, and the decree itself. If you are one of the parties named in the case, you have broader access to your own file.

Under Ark. Code Ann. § 20-18-305, some vital records are restricted to the named parties or close family for 50 years. After 50 years they become fully public. This restriction applies more to vital records held by the Arkansas Department of Health than to court records at the circuit clerk, but it is worth knowing if you are researching older cases.

Arkansas Dissolution Law for North Little Rock Residents

Arkansas requires stated grounds for dissolution of marriage. The two grounds most people use are general indignities (Ark. Code Ann. § 9-12-301(b)(3)(C)) and 18-month continuous separation (§ 9-12-301(b)(5)). General indignities covers persistent misconduct that makes the marriage unworkable. The separation ground applies when both spouses have lived apart for at least 18 months without interruption. Each ground has different evidence requirements, so the choice matters.

Residency rules apply. One spouse must have been an Arkansas resident for at least 60 days before filing, and must still be a resident when the petition is submitted (§ 9-12-303). After service on the other party, a 30-day waiting period must pass before the court can enter a final decree (§ 9-12-307(a)(1)(B)). This waiting period is mandatory -- no judge can waive it, and it runs from the date of service, not the filing date.

The Arkansas Department of Health at 4815 West Markham Street in Little Rock keeps a statewide divorce index from 1923 onward. For the actual decree or any court orders, contact the Pulaski County Circuit Clerk. Free legal help is available through AR Law Help and the Center for Arkansas Legal Services at (501) 376-3423.
